POP OFF RETURNS POLICY
1 INTRODUCTION
1.1 Anna Wilhelmina Burger (identity number: 610614 0210 088), a sole proprietor trading as “Pop Off” (“Pop Off“) wants you to be completely satisfied with your purchase of your Pop Off product. This returns policy (“Returns Policy“) applies to “Pop Off File” products purchased from Pop Off. The Pop Off File products include both: (i) hardcopy “Pop Off Files“; (ii) online “Pop Off Files” accessible on Pop Off’s website located at www.pop-off.co.za (“Website“); and (iii) the “Pop Off Will” product accessible via Pop Off’s mobile application (the “App“) (collectively the “Products“).
1.2 Nothing in this Returns Policy is intended to limit your statutory rights in any way.
2 UNWANTED PRODUCTS
2.1 In general, you can return an unwanted Product to us at no charge, provided:
2.1.1 it is undamaged; and
2.1.2 it is not missing any accessories or parts.
2.2 You can log a return by sending an email to admin@pop-off.co.za within 30 days of delivery to you or collection by you of the unwanted Product. After 30 days, you can only return a Product if it is defective within 6 months from delivery to or collection by you.
2.3 Pop Off will collect the Product from you at no charge. Our courier is entitled to refuse collection of a Product that is not properly packaged for transport.
2.4 Once Pop Off has inspected the Product and validated your return, Pop Off will refund you with the purchase price of the Product within 10 days of the return. Please bear in mind that refunds can take a few working days to reflect in your account. Pop Off is entitled to refuse a return if the unwanted Product is returned damaged, not in a re-saleable condition or missing any accessories.
3 POP OFF PRODUCTS NOT ELIGIBLE FOR RETURNS
3.1 The following Products are not eligible for a refund or exchange:
3.1.1 the “Pop Off Will” product. Once a will has been printed by you using the App, such will shall not be eligible for a refund; and
3.1.2 the online “Pop Off File” accessible on the Website.
4 PRODUCTS DAMAGED ON DELIVERY
4.1 Should a Product be damaged at the time of delivery / collection, please notify us of such delivery / collection by logging a return by sending an email to admin@pop-off.co.za.
4.2 Pop Off will arrange to collect the Product from you at no charge. Once Pop Off has inspected the Product and validated your return, Pop Off will, at your choice, replace the Product as soon as possible or refund you with the purchase price of the Product. Refunds are normally handled within 10 days of logging the return (bear in mind that refunds can take a few working days to reflect in your account).
5 DEFECTIVE PRODUCTS
5.1 Pop Off does its best to ensure that the Products Pop Off delivers to you are of a high quality and without defects.
5.2 The following will not be regarded as defects and will not entitle you to a return under this clause 5 (Defective Products):
5.2.1 faults resulting from normal wear and tear;
5.2.2 damage arising from negligence, user abuse or incorrect usage of the Product;
5.2.3 damage arising from electrical surges or sea air corrosion;
5.2.4 damage arising from a failure to adequately care for the Product;
5.2.5 damage arising from unauthorised alterations to the Product; and
5.2.6 where the specifications of a Product do not suit you.
6 STANDARD WARRANTY
6.1 If you have received a Product which turns out to be defective, please notify us as soon as reasonably possible after you become aware of the defect, but in any event within 6 months after delivery / collection of the Product.
6.2 You can do so by sending an email to admin@pop-off.co.za, and Pop Off will arrange to collect the Product from you at no charge. Once Pop Off has inspected the Product and validated your return, Pop Off will, at your choice, repair / replace the Product (if such repair / replacement is possible) or refund you with the purchase price of the Product. Refunds are normally handled within 10 days of logging the return (bear in mind that refunds can take a few working days to reflect in your account).
6.3 Please provide suitable packaging for returning the Product (it need not be the original packaging), as well as all accessories that were sold with the defective Product when you return it to us – regardless of whether you request a repair / replacement or a refund. Our courier is entitled to refuse collection of a Product that is not properly packaged for transport.
6.4 Unfortunately, Pop Off cannot facilitate returns that fall outside of the 6 month period.
7 RESTRICTION OF ACCESS TO ONLINE POP OFF FILE
7.1 To the extent that you return and receive a refund in respect of a hardcopy “Pop Off File” Product, Pop Off shall be entitled to do any of the following –
7.1.1 restrict your access to the online “Pop Off File” accessible on the Website; and/or
7.1.2 terminate your profile on the Website and permanently delete and destroy all of your personal information in connection therewith.
8 CHARGES
8.1 If you return a defective Product to us, but you fail to return all of the accessories that were sold with that Product, Pop Off shall be entitled (subject to applicable law) to refuse the return, only to replace the item that you did return, or to estimate the value of the missing accessories and only to refund you in respect of the returned item.
8.2 If you return Products to us by mistake and you want these returned to you, you may be liable to reimburse Pop Off for the cost of having the Product returned to you.
8.3 If you return a Product that does not comply with this Returns Policy, you may be liable to reimburse Pop Off for the cost of collecting the Product from you and the cost of having the Product returned to you.
